Terms of service

These terms cover your use of brandflare. By creating an account or subscribing you agree to them. They are written to be readable; if anything is unclear, ask us through our contact form or at hello@brandflare.io before you buy.

Who the agreement is with

brandflare is operated by NONE OF THE ABOVE L.L.C-FZ, licensed by Meydan Free Zone under licence number 253577901, with its registered office at Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, United Arab Emirates. “We” and “us” mean that company.

For businesses

brandflare is a business tool. By using it you confirm that you are at least 18, that you are acting for a business rather than as a consumer, and that you have authority to accept these terms on its behalf. You are responsible for the people you invite to your workspace and for keeping your sign-in details secure.

What we provide

We ask AI assistants a set of questions on a schedule, record how they describe your brand, and present the results. Your plan sets how many brands and questions you can track and how often we check. The Free plan lets you browse the public index without tracking brands of your own.

We work to keep the service available and will give notice of planned maintenance where we can, but we don't promise uninterrupted access. We add, change, and occasionally remove features; the changelog records what changed.

What we don't promise

AI engines change their answers without notice, and we don't control them. We report what they said when we asked. We don't guarantee any particular score, ranking, or improvement, and measurements are estimates based on a sample of questions rather than a complete census of what every user sees. Recommendations are suggestions, not professional advice; whether to act on them is your decision.

Free trial

The Pro plan can be started with a 14-day free trial, once per workspace. We take a card when the trial starts and charge nothing until it ends. Unless you cancel before then, the subscription begins and the card is charged for the first period.

Payment

Subscriptions are billed in advance, monthly or yearly, through Stripe, and renew automatically until cancelled. Prices are in US dollars and exclude VAT and any other tax we're required to add. If a payment fails we may pause checks and make the workspace read-only until it clears; what you've already measured is kept.

If we change the price of your plan we'll tell you by email at least 30 days before it takes effect, and it will apply from your next renewal.

Cancelling and refunds

You can cancel any time from Settings. You keep access until the end of the period you've paid for, and we don't refund or pro-rate part-periods. If something went materially wrong on our side, contact us. We'd rather sort it out than argue about it.

Your content

The brands, questions, and facts you enter remain yours. You give us permission to process them to run the service, and you confirm you have the right to enter them. The scores and analysis we generate are ours, and you're free to use them, and the reports you export, in your own and your clients' reporting.

The product, its design, the brandflare name, and the scoring method belong to us. We may use aggregated results that don't identify you or your workspace to improve the service and publish research.

Acceptable use

• Don't use brandflare to impersonate a brand you have no connection to.
• Don't resell raw access to the product without an Agency plan.
• Don't try to overload, scrape, or reverse-engineer the service.
• Don't use it to break the law or anyone else's rights.

Privacy

How we handle personal data is set out in the privacy policy and the cookie policy.

Liability

To the extent the law allows, our total liability is limited to what you paid us in the 12 months before the claim. We're not liable for lost profits or indirect losses arising from decisions made using our measurements, or for events outside our reasonable control, including outages and changes at the AI providers we measure. Nothing in these terms limits liability that cannot be limited by law.

Ending the agreement

You can stop at any time by cancelling. We can suspend or close an account that breaks these terms or doesn't pay, and we'll tell you why. The sections on content, liability, and governing law continue to apply after the agreement ends.

Changes to these terms

If we change these terms we will update the date at the top and, for anything material, email account holders at least 30 days before the change takes effect. Continuing to use brandflare after that means you accept the new terms.

Governing law and disputes

These terms are governed by the laws of the Dubai International Financial Centre. Any dispute arising out of or in connection with them, including any question about their existence, validity, or termination, shall be subject to the exclusive jurisdiction of the Courts of the Dubai International Financial Centre. Please talk to us first; most problems are quicker to fix than to litigate.

The rest

These terms, with the privacy and cookie policies, are the whole agreement between us. If a court finds part of them unenforceable, the rest still stands. You may not transfer the agreement without our consent; we may transfer it if the business is sold or reorganised. Formal notices go to hello@brandflare.io, and to the email address on your account.
